Appellate Practice

We have a full service appellate team in South, Central and Northern Florida to assist our clients. We find it is a significant cost advantage to our clients to have their trial and appellate lawyers working in the same firm. Our Appellate division provides key support before, during and after trial to ensure we present decisive legal authority for our position. The Appellate team assists also with summary judgments, motions in limine and post trial motions and we handle appeals in State and Federal Appellate courts in various substantive areas including coverage, first and third party bad faith and traditional liablity defense, such as threshold and set-off issues in motor vehicle accidents, premises liability, product liability, liability and worker's compensation defense.

Luks Santaniello has many published opinions and has made new law for businesses and insurers. For example, our client was recently affirmed in the landmark case of Garcia v. Vanguard, wherein we successfully defended the 2007 Graves Amendment's constitutionality under the Commerce Clause of the U.S. Constitution and Florida's Financial Responsibility Act. The Appellate Practice Team is also available to assist our clients with challenges to proposed state constitutional amendments, statutes, and administrative rules.
